Submission Rules
To enter the Contest, you must register online, and submit a photograph of your child. New Entries will be received until Wednesday September 27th. One entry per person. Each photo must be submitted by a parent/legal guardian over the age of 18. Once your image is submitted you are ineligible to enter again. By submitting your photo you are automatically agreeing to the Official Contest Rules and Regulations. The parent/legal guardian must give a valid email address. Please keep images close to 100KB in size. We accept photographs sent in JPEG format only. Upon submitting your photo to belle&beanzer, the parent/legal guardian agrees not to submit the photograph to any other media outlets without the express written consent of belle&beanzer. Parent/legal guardian warrants that the photo submitted is original and not previously published, and that the parent/legal guardian owns the copyright in such photo.
All photos submitted to belle&beanzer LLC will become property of belle&beanzer LLC. Upon submission, you grant belle&beanzer LLC the right to use the photo(s) in all forms of media, including throughout any of our publications (printed, online, or otherwise) and in our partners’ publications and websites. Please do not include photos with a clearly branded product. if you do, you are responsible for obtaining the necessary releases, and must be able to provide those releases to belle&beanzer upon request. Participation in the belle&beanzer embracing the moment photo contest constitutes full and unconditional agreement to, and acceptance of, these belle&beanzer embracing the moment photo contest Submission Rules (the “Official Rules”).
These competitions are open to any U.S. resident (unless otherwise stated) except employees of belle&beanzer LLC, their agents or anyone directly connected to these promotions. No purchase required for this promotion. Contest valid Monday, September 10th 2012 through Monday, October 8 2012. Parent of winner must be 18 years of age or older unless otherwise stated. Only babies 12 months or under, at the time of entering the Contest are eligible to compete. Prizes are as described below; no cash alternatives will be given. Prizes may not be sold, traded, transferred or refunded. No makeup goods will be given in the event of a canceled or rescheduled event. Prize package: (1) 3-piece Holiday 2012 gift pack & a photo shoot with your baby as the embracing the moment holiday baby.
Any violations of the rules will be cause for disqualification or other contest changes to be determined by belle&beanzer LLC. The winner of the Embracing the Moment photo contest, in it’s various stages, will be determined by belle&beanzer at our sole discretion. *belle&beanzer reserves the right to change these rules at any given time.
SELECTION OF FINALISTS AND WINNER:
Each photograph submitted must be approved for posting on the Contest website by a member of belle&beanzer's photo selection committee. Photos may be approved or rejected based on suitability (for example, no pet or adult photos are appropriate) for the Contest at belle&beanzer's sole discretion. Only those photos that are approved for posting will be deemed eligible to win the Contest.
One(1) Grand Prize winner will be chosen from the belle&beanzer panel of judges as best photograph depicting embracing the moment, and One (1) Winner by Popular Vote will be the entrant that submits the photograph that receives the most public on-line confirmed votes (Facebook "likes") from the voting public during the applicable four (4) week Contest period. For purposes of the Contest, a "vote" means a vote cast on the Contest Website, by a "unique voter." A "unique voter" is an individual person: (a) who has registered on the Contest Website and confirmed their registration by clicking on the email sent to them at the email address they used to register; and (b) with unique registration information (i.e., email address) that is not duplicative of another voter's information. A unique voter may vote for as many photographs as they like, but may vote no more than once any one photograph. belle&beanzer determines, in its sole discretion, that an abuse of the "unique voter" rule has occurred, belle&beanzer may disqualify votes cast by such voters or entrants, including if more than five(5) of such voters or entrants registered from the same computer "IP address" in a single calendar month.
If there is an exact tie in the number of votes cast for two(2) or more photographs, then the winner will be determined by the belle&beanzer panel of judges. Winners will be determined within 7 days of contest close; however, belle&beanzer reserves the right to take more or less time to determine the winner as it deems necessary in its sole discretion.
The winner will be notified by phone or email. Each winner will be selected based upon the results of online voting, and will be subject to approval by belle&beanzer pending confirmation of each such winner's compliance with these Official Rules. belle&beanzer's decisions are final on all matters relating to this Contest. Any ambiguity in questions or answers will be resolved at the sole discretion of belle&beanzer. Entrants agree to cooperate with publicity that may arise.
INDEMNIFICATION:
You agree to release, indemnify and hold belle&beanzer, its parents, subsidiaries and affiliates, and each of their respective members, officers, directors, employees, agents, shareholders, licensors, suppliers, co-branders, attorneys and/or other partners, harmless from and against any and all claims, expenses (including reasonable attorneys' fees, costs and settlement costs), damages, suits, costs, demands and/or judgments whatsoever, made by any third party due to or arising out of: (a) your use of the Contest and/or the Contest Website; (b) your breach of these Official Rules; and/or (c) your violation of any rights of another individual and/or entity. The provisions of this paragraph are for the benefit of Company, its parent, subsidiaries and/or affiliates, and each of their respective members, officers, directors, employees, agents, shareholders, licensors, suppliers, co-branders, attorneys and/or other partners. Each of these individuals and entities shall have the right to assert and enforce these provisions directly against you on its own behalf.
LEGAL WARNING:
Any attempt by any individual, whether or not an entrant, to damage, destroy, tamper with or vandalize the Contest or Contest Website, or otherwise interfere with the operation of the Contest, is a violation of criminal and civil law and belle&beanzer will diligently pursue any and all remedies in this regard against any offending individual or entity to the fullest extent permissible by law and in equity.
